Contractor Vetting

Review relevant experience, references, proposed personnel, workload, required qualifications, insurance, and available financial and bonding information. Document concerns before the owner selects a contractor.

Negotiation & Contract Review

Represent the owner in commercial negotiations and review the complete contract package for gaps, conflicting terms, and missing owner protections. Address scope, general conditions, schedule commitments, delay exposure, payment, and closeout, with legal language and agreement drafting coordinated through construction counsel.

Performance & Payment Bonds

Help owners evaluate bonding needs, particularly for larger or higher-risk projects. Coordinate with the owner’s surety adviser and attorney to review proposed requirements, verify issued bond documents, and track outstanding items before work begins.

Schedule of Values Review

Review the contractor’s proposed schedule of values before the contract is executed. Flag front-loading, unsupported allocations, and payment timing that could leave the owner paying ahead of the work or strain available project funding.

Monthly Payment Application Review

Review AIA G702/G703 or equivalent applications against the contract, schedule of values, approved changes, prior billings, retainage, and supporting records for progress and stored materials. Identify questions and recommend adjustments before owner approval.

Project Funding & Cash Flow

Forecast monthly funding needs against the construction schedule. Track approved commitments, actual payments, potential changes, contingency, and retainage so the owner can plan cash availability and coordinate lender draw timing where applicable.

We review all contract documents provided for the engagement as one coordinated package: the agreement, general and supplementary conditions, drawings, specifications, exhibits, addenda, amendments, and incorporated proposals or clarifications.

The review identifies omissions, inconsistent requirements, and missing language that may expose the owner to avoidable costs. We document recommended corrections and coordinate resolution with the project team and construction counsel before execution.

General & Supplementary Conditions

Review responsibilities, document precedence, notices, claims, changes, payment, and closeout requirements. Flag conflicting terms, undefined obligations, exclusions, or missing language that could shift unexpected costs and responsibilities to the owner.

Liquidated Damages & Completion

Review completion milestones, proposed amounts and triggers, time extensions, and the interaction with damage waivers and other remedies. Coordinate with construction counsel on language, anticipated owner losses, and enforceability.

Weather & Unforeseen Delays

Review normal weather allowances, unusually severe weather, unforeseen conditions, and other delay events. Clarify time-only versus cost relief, notice deadlines, schedule-impact documentation, mitigation duties, and approval procedures for added time or money.

The goal is to establish who carries each risk, what must be documented, and how decisions are approved, reducing avoidable delay charges and uncertainty when conditions change.

Performance Bond

Addresses the contractor’s failure to perform its bonded contract, including default, subject to the bond’s terms and required procedures.

SUBCONTRACTOR & SUPPLIER PAYMENTS

Payment Bond

Addresses covered payment obligations to subcontractors and suppliers. It provides a separate safeguard when a contractor does not pay eligible project participants.
